When you’re injured in a car accident as a passenger

Car crashes are scary under any circumstances, but maybe doubly so when you’re just a passenger in one of the vehicles involved. After all, you have no control over any part of the situation.

Nonetheless, you may end up with significant injuries — with all the financial stresses that go along with hospital bills and not being able to work. The one thing you have in your favor is that you are not responsible for any part of the accident. Therefore, somebody else should be required to cover your losses and compensate you.

Here are some of the possibilities:

1. One or both of the drivers

Since you were a passenger, it’s not really your concern who was at fault for the accident. However, you may have to file a lawsuit against both drivers involved in order to get fair compensation — especially if your injuries are particularly grave.

2. The owner of one of the vehicles

Sometimes, one of the drivers may not be the owner of the vehicle they’re using. Maybe they borrowed the car from a friend for the afternoon or maybe they were driving a delivery truck for work. Either way, the owner’s insurance company may ultimately be required to pick up the tab.

3. An auto manufacturer or parts company

Sometimes accidents happen because of an equipment failure. One of the vehicles may have been badly designed, turning a minor fender-bender into a major wreck. Other times, a single part is to blame — such as when a blown tire causes a chain reaction that leads to a crash.

Determining who is liable for your losses in a crash can be complicated and difficult to do — especially when you’re trying to recover from serious injuries. Fortunately, you can seek legal assistance with your claim.
